Car Hire Terms and Conditions

The client (hereinafter referred to as lessee) proposing to hire a vehicle (hereinafter referred to as the car) from the leasing agency cheapcarhiremalaga.co.uk (hereinafter referred to as lessor) agrees to abide by the following general and specific conditions:

Rental Use

Car Pickup

Standard procedure for pickup: lessee will communicate arrival time to the lessor and an agent will greet and transport them from their flight at the Malaga airport to car pickup location, normally within 5 minutes or less. Prior arrangement may be made to have the car delivered directly to the Malaga airport outside office hours or anywhere else on the Costa del Sol, subject to additional fees.

Lessee must present full payment, a valid credit card, current driving licence and passport at time of rental. Furthermore, each secondary driver must also present a valid driving licence and passport at this time. (See Payment and Driver Experience sections for further details.)

Car Return

A two-hour grace period is allowed upon returning the car, in reference to the predetermined return time. There is no extra charge for returning the car outside office hours. Notwithstanding, the lessor is fully authorised to withdraw the lessee's car at any moment, provided that it has not been returned within the contracted rental period.

Lessee must return the car to the lessor on the date stated at rental time and undertake to keep the car, its equipment and tools in perfect conditions and working order. Any alteration should be previously authorised by the lessor. Should this obligation not be fulfilled the lessor may lawfully demand the return of the car. In such case the lessor may also claim indemnity for each day's delay in dropping off the car from the final date of the contract, according to the applied rate, as well as the cost of recovering the car and the damages it may have suffered outside of the contracted period.

Driver Experience for Car hiring

The principal and any additional drivers must have a current, valid driving license issued in their name. Licence must be issued a minimum time prior to the rental period. This minimum driving experience and minimum age of the driver can be determined from the following table:

Car renting Prohibitions

The following are strictly prohibited and may result in loss of all rights:

• Driving of the car by persons not identified at time of pickup and authorized by the lessor
• Using the car for the transportation of goods
• Using the car to push or tow other vehicles
• Participation in races or contests of any kind
• Driving the car under the influence of alcohol and/or drugs
• Travelling in the car with more persons than the number specified by Law for that particular car
• Driving beyond the limits of the Iberian Peninsula, unless express authorization is obtained from the lessor

Car Hire Payment

Full payment is due at the time of rental, before collecting the car. Payment for the car hire at pickup time is done via secure means; therefore, the lessee is not required to provide a credit card number before this time. Acceptable payment forms are cash, VISA and MasterCard; however, a valid credit card will always need to be presented as surety at the time of rental, regardless if payment is made in cash. The local currency prices shown on our pages are estimated prices provided for your convenience. Rental is paid in Euros. Your actual cost may vary depending upon currency conversion rates used by your credit card company.

Charges

Deposit

At pickup time the lessee will pay the estimated rental fee plus a deposit based on the current contract guarantee rate. This deposit will be returned to the lessee at the end of the rental period provided its use is not necessary to cover extraordinary costs incurred by the lessee.

Rental Car Petrol

Car will be pre-filled with half a tank of fuel. Lessee will pay for this fuel as part of the final price, and the car may be returned empty.

Mileage

The principal fee charged for car hire is based on the rental period, season and any applicable offers. Lessee will not be charged for the number of kilometres travelled with the car.

Rental Car Extras

Principal and additional driver are included in the agreement with no extra cost. Additional drivers must be declared at pickup time and are charged 1€ per day per driver.

• Baby Seat – 2€ / day
• GPS (Global Positioning System) navigational unit – 5€ / day
• Standard Office Hours: 09:00 - 22:00
  Car delivery to Malaga airport outside office hours – 15€
  Car return outside office hours – no extra charge
• Car delivery to location besides Malaga airport – contact lessor

Car Rental Insurance

General Coverage

Civil responsibility of the lessee with respect to damages caused to the car in case of fire and theft (upon turning in keys) is totally covered, and partially in case of an accident with an insurance excess according to the current rates. This excess is waived if the lessee obtains the collision damage coverage at the time of rental. The number of days in which the car is immobilized are not covered by the insurance, and the lessee will compensate the lessor in accordance with the current rates of the type of car hired.

Accidents

In case of accident the lessee is obligated to the following (under possible loss of insurance):

• Contact the lessor within 24 hours from the time that the accident occurred.
• Obtain and submit to the lessor all of the other party's information and that of possible witnesses within 48 hours after the accident specifying details about the circumstances, place, date and time of the accident.
• Notify the authorities immediately if fault of the other party should be investigated or if there are injured persons.
• Do not admit or place blame for the accident.
• Do not abandon the car without first taking the necessary measures to protect it.

Exclusions

The insurance excludes:

• Accidents due to the influence of alcohol and/or drugs
• Drivers without a valid driving licence
• Tire punctures (total or partial), damage to the wheel including rims and/or hubcaps, and lost or stolen hubcaps
• Damage suffered by the car as consequence of uneven or poorly conditioned roads, or caused by driving on non-paved roads
• Damage incurred outside of the effective rental period stated in the contract
• Accidents or damages as a result of objects transported inside the car, if the lessee deliberately provides inaccurate information as to their identity, home or validity of their driving licence
• Damage caused to the car undercarriage and all incurred costs
• Damage caused by using the incorrect type of fuel and all incurred costs
• Damage caused to the clutch from improper use and all incurred costs
• Expense incurred in obtaining a copy of the car's keys in the cases of loss, breakage or robbery. Also, the lessor may charge for the extra days that the car cannot be rented out due to any of the reasons listed in this section.
